1. Acceptance of Terms
By accessing or using the SMARTERMAKE platform, you agree to be bound by these Terms of Service. If you do not agree, please do not use our services.
2. Services
SMARTERMAKE provides an online platform for quoting, ordering, and managing 3D printing and CNC machining services. We act as an intermediary between customers and our network of manufacturing partners.
3. User Accounts
You are responsible for maintaining the confidentiality of your account credentials and for all activities under your account. You must provide accurate, current information during registration.
4. Orders and Payments
All prices are quoted in USD. Payment is due at the time of order placement. We accept major credit cards, PayPal, and wire transfers for enterprise customers. Prices include manufacturing costs and exclude shipping, duties, and taxes.
5. Intellectual Property
You retain all intellectual property rights to the designs, models, and files you upload. SMARTERMAKE does not claim ownership of your designs. We implement strict data handling procedures to protect your IP.
6. Quality and Tolerances
Parts are manufactured to the specifications in your order. Standard tolerances are +-0.3% or +-0.3mm, whichever is greater, for 3D printing and +-0.05mm for CNC machining, unless otherwise specified.
7. Shipping and Delivery
Estimated delivery dates are provided at checkout and are not guaranteed. SMARTERMAKE is not liable for delays caused by shipping carriers, customs clearance, or force majeure events.
8. Returns and Refunds
Our return policy is outlined in detail on our Returns page. Claims must be submitted within 14 days of delivery. Manufacturing defects are covered; design errors are not.
9. Limitation of Liability
SMARTERMAKE total liability for any claim arising from the use of our services is limited to the total amount paid for the specific order giving rise to the claim. We are not liable for consequential damages.
10. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the laws of the Hong Kong Special Administrative Region. Any dispute arising out of or in connection with these Terms or the use of our platform shall be submitted to the exclusive jurisdiction of the courts of Hong Kong. The United Nations Convention on Contracts for the International Sale of Goods (CISG) does not apply. Each party irrevocably waives any objection to venue in such courts.
11. Changes to Terms
We reserve the right to modify these terms at any time. Users will be notified of material changes via email. Continued use after changes constitutes acceptance.
